yes my OCD strike again. this is old annoyance though

In display settings when I have JUST my dvi monitor connected windows see it identity 1 , When my hdmi hdtv is connected the hdtv becomes identity 1 and dvi monitor identity 2.

win key +p shows this as

dvi monitor (pc screen only) when it only connected
    when
dvi monitor and hdmi hdtv is connected
dvi becomes (second monitor only) and hdmi hdtv becomes (pc screen only)

Is there way to make windows stop this, I want monitor to stay identity 1 and there for (pc screen only) and hdmi hdtv to become (second screen only)

my monitor -DVI is primary under system display but identity number is what dictates what is PC screen only( identity 1) and what is Second screen only (identity 2) and as soon as my hdtv-hdmi is connect it steals identity 1 and make the monitor-dvi 2

Which make my dvi monitor (second screen only) which primary under system/display

Okay, now I see your problem - Looks like windows thinks HDMI is primary hence moving DVI secondary... any way to switch cables provided ports are there? Other than that I am out of ideas..
