Man jailed for collecting water in backyard

    In theory, it's because you're preventing it from flowing into a stream etc.
    Even if the stream is on your property, you can't dam it up.

    Still i think this is all completely ridiculous.
    At least people aren't getting in trouble if their land already has a natural lake or pond. At least not that i'm aware of such an incident.

    So using natural resources and converting them to private ownership for the means of generating services for profit is not Capitalism?

    It certainly is part of Capitalist policy, I guess state owned threw you off? How about a privatised subsidiary of the water utility that would have been state owned in a Non Capitalist system for the benefit of the people rather than for generating profit and fining some lone man for collecting a natural resource on his own land.

    The laws are deferent in every state but Just because you own the land . doesn't mean you own the water rights , Its like allot of the stuff under your land . Oil Gas coal minerals etc etc . Who ever owned the land before you could of sold all that off , Anytime you buy any property make sure you have all the minerals rights , If not anyone at anytime can come in and start drilling and you cant do a damn thing about it lol

    If somebody comes into my property with or without right to starts digging/drilling there are two options:
    A)He is beaten by me and my family really badly almost to death
    B)He dies by gunshot or like in "A" option just without the almost word
    It's a true fact.In my lands people are really territorial and nobody is scared by the law and accordingly nobody values it lol

    Over here the streams and springs are owned by the community, ie. the municipality, to ensure that everyone gets to use it instead of some individual who hoards it.

    If someone else owns the mineral rights to your land, it doesn't mean people can come onto your land and drill.
    Not sure where you guys got this.
    HOWEVER!
    Your neighbor may be easily bought off, and they could drill on their land, diagonally to your ______ resource. Since they'd have the right to the resources under the surface.

    They could pay your neighbor $50k - $200k, money they wouldn't have received otherwise.

    As for collecting the water from a stream, you wouldn't have the right to put up a dam on your property blocking a stream from flowing into the neighboring properties.
    Collecting rain water, is essentially making a passive dam, stopping that water from flowing into neighboring lands.

    This is an interesting case. Some it appears, are not aware the complicated issue property/mineral/water rights.
    I'm sure you'd all agree that if this guy was using herbicides for example and the runoff from his land was killing off the vegetation of his neighbors, you'd surely recognize there are reasonable limits as to what one can do with resources on their land.

    Well thats not really true hemi.
    If i wanted to go to homedepot and get some herbicide as long as i did not spray it in the water i could just dump the whole container right on the ground. When it rains you get my(whatever)in the runoff...all legal like.
    I dought its a few rain barrels in this case

    Lol, Guys I'm sorry, but i have to inform you that I'm the owner of all raindrops on planet, and air you breathe.

    So, i will give mine private account number, and you can all pay to me, if not, i will be forced to use the law and put you in jail.

    On serious note, i don't believe that is true (as someone already stated in topic), and if it is, the judge who jailed him should be banned for life from working anything other than digging some ground for highway etc.
