Im no mechanic, but it doesn't look like a fuel tank, looks like a scratched protective covering, plastic / metal ? Just a guess from the pics
Most new cars in the US don't..... Pill, that first image looks like a cracked skid plate.....which covers the bottom of most BMWs for improved aerodynamics. Second image, I can't comment on as it's been a while since I've been inside a BMW....
OK cheers. Yeah I want one exactly the same but with wood/black leather interior, this one has cloth/chrome. Worse though is every single wheel has been curbed to death, pretty amazing since it hasn't even done 30k. Damn Japanese drivers.....
The "gas tank" picture would be a lot easier to see if you could pull the camera back farther, but it doesn't look like a gas tank to me. Kind of hard to tell if I'm looking at a removable plastic plate or just the bottom of the floor pan from so close though
gas tanks usually somewhere between trunk and rear axles and no lower than axles themselves so you do not puncture them that easy. As people said, it is protective plastic that got hit or scratched. There is some leak on a tire though and it seems like it is coming from above, could be from the shock absorber? Must have hit something really hard.

The first picture is just a cracked splash shield as already mentioned. These E39 bimmers have a "camel shaped" fuel tank to allow clearance for the drive shaft. The area in the center console is where the two front cup holders pop out from. Common to break. Also it looks like someone has added some aftermarket E39 M5 body panels to this car. To me that screams "stay away!!" *Unless I just can't see the M5 badge on the door molding? I think you would better of with the manual transmission as well. Much more reliable. Probably my favorite 5-series. I had a Silver E39 540i w/ M-package, 6 speed manual for a brief time. It constantly needed work, but it was a great car.
