The only thing I can find on Modbook, Inc. is it is a privately owned company that does development work for Apple. I would assume they have Apple's blessing with this otherwise we will be hearing about another lawsuit shortly.

they most likely have a 'blessing', if not a subsidiary/sister company, of apple. Apple sues even non-tech/IT related stores brand/stores that has the littlest of hints of apple, so it would be a surprise if Apple won't sue them if they are not in any way related to them.
