sapphire HD4850 COD4 issue please help :(

Call of duty 4 is working very good with the in game engine but the intro and video cutscenes verry choppy and the audio stutters. I noticed that the frame rate when testing with fraps is in the hundreds during these cutscene videos when they are briefing you for your missions. It's very interesting because when I record a video with fraps it keeps the frame rate at 30fps and the problem doesn't occur until the 30 sec. clip has finished. If I enable v-sync in game it will also fix the problem and keep the frames at 60 for the cutscenes but I don't want to play with v-sync. I also noticed that the in-game console command /com_maxfps did not work when I tried to set the max fps. I could swear on my old card (7950gt) that even without v-sync enabled these cutscene videos would play at 60 fps. What could it be that's not controlling the frame rate correctly for these parts of the game? I would really appreciate some help or advice on this because I am trying to rule out any hardware problems with my new build. So far this is the only problem I have encountered with any game or benchmark. I have tried the 8.6, 8.7, and 8.8 Catalyst and all three sets have the same issue with COD4.
